1. Acceptance of Terms

By accessing or using Ballista ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

Ballista provides a platform for users to send physical mail containing resumes and cover letters to potential employers. Our service includes:

Resume and cover letter upload and storage
Cover letter personalization (optional)
Custom brand design for cover letters (optional)
Physical printing and mailing via USPS through our printing partner (Postgrid)
Mail tracking (available with certain service tiers)

3. Credit System

Ballista operates on a prepaid credit system:

Credits are purchased in packs and used to pay for services
Credits never expire
Credits are non-refundable once purchased (see Refund Policy)
Credit costs vary by service: mailing (500-2200 credits), cover letter (16 credits), brand design (61 credits)
Credit balances can be viewed in your dashboard at any time

4. Referral Program

Ballista offers a referral program that rewards users for referring new customers:

Eligibility: All registered users receive a unique referral link that can be shared with others
Bonus: Both referrer and referee receive credits equal to one standard mailing when the referred user makes their first credit purchase
Limitations: Each user can only be referred once. Self-referrals are not permitted. Referral bonuses are non-transferable and non-refundable.
Abuse: We reserve the right to void referral credits and terminate accounts for fraudulent activity, including creating fake accounts or manipulating the program
Modifications: We may modify or discontinue the referral program at any time without prior notice. Pending referrals may be honored at our discretion.

5. User Obligations

You agree to:

Provide accurate recipient information (company name, address, hiring manager)
Upload only content you have the legal right to send
Comply with our Acceptable Use Policy
Not use the Service for spam, harassment, or illegal purposes
Not reverse engineer, copy, or redistribute any part of our Service

6. Mail Processing and Delivery

Processing Time: Mail is processed and sent on the next business day after order placement
Delivery Times: Both Standard and Premium tiers use USPS First-Class Mail with 5-7 business day delivery. Premium adds certified tracking and delivery confirmation.
No Guarantees: While we use reliable mail carriers (USPS), we cannot guarantee exact delivery dates or successful delivery
Address Verification: You are responsible for providing accurate addresses. We offer address lookup tools but do not guarantee address accuracy
Undeliverable Mail: If mail is returned as undeliverable, credits are not refunded

7. Cancellations

Orders can only be cancelled while in "ready" status (before printing begins). Once printing has started, orders cannot be cancelled. Refunds for cancelled orders are issued as credits to your account, not cash refunds.

8. Intellectual Property

You retain ownership of all content you upload (resumes, cover letters). By using our Service, you grant Ballista a limited license to:

Store your content on our servers
Process and print your content for mailing purposes
Use anonymized data for service improvement

We will never sell, share, or use your personal content for marketing without explicit permission.

9. Limitation of Liability

Ballista is not liable for: lost mail, delayed delivery, recipient actions or reactions, employment outcomes, or any indirect damages. Our maximum liability is limited to the amount you paid for the specific service in question.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. Unused credits will be refunded if the Service is permanently discontinued.

11. Termination

We may terminate or suspend your account for violations of these Terms, fraudulent activity, or misuse of the Service. You may close your account at any time through your dashboard settings.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration.
